LUXURY EXPERT PARFUM S.R.L<\/b>., company with registered office in Sat Balotesti Com. Balotesti, Sos. Unirii, Nr.29, Bl.P10, Sc.3, Et.P, Ap.21, registered in the Trade Register under number J202300075222230, fiscal registration code RO47578079, (hereinafter referred to as \"Organizer\" \/ \"Promoter\").<\/p><p>By participating in the Program, the participant accepts these terms and conditions:<\/p><p><b>1.  Aim of the program<\/b><\/p><p>The program aims to reward loyal customers who make purchases on the platform<a href=\"http:\/\/morphparfum.ro\/en\/\"> morphparfum.ro<\/a>by awarding value points (\"Morph Points\" or \"MP\"), which can be used exclusively to obtain products offered by the Organizer within the loyalty thresholds.<\/p><p><b>2. Eligibility and participation in the program<\/b><\/p><p>2.1. The Program is open to participation of any natural person aged 18 years or older at the date of the start of the Program, with full capacity to exercise their right to exercise their full legal capacity (\"Participant\"), as of June 1, 2025.<br \/>2.2. The decision to participate in this Program belongs to each participant, who by enrolling unequivocally undertakes to comply with all the provisions mentioned in these Terms and Conditions, binding for all participants.<br \/>2.3 In order to participate in the Program, the client must create a user account on <a href=\"http:\/\/morphparfum.ro\/en\/\">morphparfum.ro<\/a> and carry out authenticated orders on your account.<br \/>2.4. Points earned are nominal and can only be used by the account holder.<\/p><p><b>3. Participants<\/b><\/p><p>3.1 \"Participant\" means a consumer - as defined in accordance with Article 2, point 2 of the Consumer Protection Ordinance no. 21\/1992, as amended and supplemented, who has a valid Morph\/Morph ID account.<br \/>3.2 The Participant must have a valid Morph account, registered through the official Morph channels (the Morph App and the official website morphparfum.ro) and log in to the account.<br \/>3.3. Continued participation in the Program constitutes the Participant's full and unconditional agreement to these Terms and Conditions, as they may be updated from time to time, and confirmation by the Participant that he\/she meets the eligibility requirements.<br \/>3.4. Participant's personal data: their processing will be done in accordance with the Morph Parfum Romania Privacy Policy available on the official website morphparfum.ro.<\/p><p><b>4. Program modification and termination<\/b><\/p><p>The Promoter reserves the right to suspend or terminate the Program at its sole discretion at any time without prior written or verbal notice.<\/p><p><b>5. Accumulating points<\/b><\/p><p>5.1. Participants accumulate Morph Points MP on purchases made through the official Morph channels (Morph App or the official website www.morphparfum.ro), while logged into their Morph ID account.<br \/>5.2 With each purchase on the website or via the app, the customer <b>receives 10% of the order value in Morph points <\/b><b>(MP)<\/b>.<br \/>Example: If the customer has purchased products worth 3000 ron, his account will automatically be charged with 300 Morph Points (MP), equivalent to 300 ron. Shipping is not included.<br \/>5.3. Points will be credited to the participant's Morph ID account after confirmation of payment and delivery of the order, within 7 working days.<br \/>5.4. The amount spent is calculated exclusively on the basis of the purchased products (excluding transportation costs or other taxes).<br \/>5.5 The Organizer\/Promoter reserves the right to invalidate the points in case of cancellation or return of the order for which they were awarded.<\/p><p><b>6. Points value, transferability and expiration<\/b><\/p><p>6.1 Points do not constitute property, have no cash value and are not transferable.<br \/>6.2. The points are valid until they are used, remaining in the Morph account until they are used.<br \/>6.3. MP Morph Points cannot be exchanged for cash.<br \/>6.4. Morph Points MP points can only be used to obtain products from www.morphparfum.ro. They cannot be used to reduce the value of an order.<\/p><p><b>7. Use of accumulated points<\/b><\/p><p>7.1. Points can only be used on official Morph channels, exclusively online on <a href=\"http:\/\/morphparfum.ro\/en\/\">morphparfum.ro<\/a> or via the app.<br \/>7.2 Points cannot be used for digital products, external services, or orders placed by companies\/firms.<br \/>7.3. To obtain a product you must have <strong>the full number of points required for that product<\/strong>. If you don't have enough points, they remain active in your account until you accumulate the required number.<br \/>7.4. Points cannot be transferred between accounts and no invoices are issued for them, as they are shown as a discount.<br \/>7.5 The Promoter reserves the right to change the list of products and services for which points can be used.<br \/>7.6 Points cannot be converted into cash and cannot be used to reduce the value of an order.<br \/>7.7. Products obtained through the Program cannot be exchanged or returned.<br \/>7.8. Points remaining in the account after redemption may be used for future purchases in accordance with this Regulation.<\/p><p><b>8. Protection of personal data<\/b><\/p><p>8.1 The processing of personal data is carried out in accordance with Regulation (EU) 2016\/679 (GDPR).<br \/>8.2. Participants' data are used exclusively for the administration of the Program and will not be disclosed to third parties without the client's consent, except in the situations provided by law.<br \/>8.3 For further details, participants can consult the Privacy Policy available at <a href=\"https:\/\/morphparfum.ro\/en\/\">morphparfum.ro<\/a>.<\/p><p><b>9. Additional conditions<\/b><\/p><p>9.1 The Organizer may suspend a participant's eligibility if there is suspicion of fraud.<br \/>9.2 Any attempt to manipulate or defraud the Program may result in civil and\/or criminal liability.<br \/>9.3 This document is governed by Romanian law. No provision may limit the rights conferred on consumers by applicable national law.<\/p><p><b>10. Limitation of liability<\/b><\/p><p>10.1 The Promoter and its affiliates are not responsible for technical errors, malfunctions or other situations that may affect participation in the Program.<br \/>10.2. By participating, each participant exempts the Promoter from any liability for damages arising from the use of the Program.<\/p><p><b>11. We are a company that deals with online sales of niche perfumes.<\/p><h2>Your personal data<\/h2><p>The Website processes personal data provided by you or collected from other sources as we have described in detail in the Privacy Policy. We are committed to complying with national and European legislation on the protection of personal data and the free movement of such data.<br \/>By visiting and\/or using the website, placing orders or interacting with us by any method and\/or any means of remote communication, you consent to the processing of your personal data as described in our Privacy Policy.<br \/>You also declare that all personal data and information submitted to us is up-to-date, accurate. To the extent that the data does not belong to you, you declare that you have obtained the prior written consent of the data subject whose data you are transmitting to us or that you are transmitting the data on another legal basis as provided for in Regulation (EU) 679\/2016.<br \/>We may collect information through cookies or similar technologies, such as your IP address, browser or device. Once you have placed all the products you wish to buy in your shopping cart, you will be able to place your order by scrolling through the order page. On the order page you will provide the following information:<br \/>Delivery method;<br \/>Order details: name, surname or company name, e-mail address, telephone number and delivery address;<\/p><h2>Product availability<\/h2><p>We cannot guarantee that products that were at one time on the website will be available for purchase at any time. We will have no liability to you in the event that a product is no longer on the site.<br \/>Although we will attempt to have real time product availability information updated on the website, we cannot guarantee that this information will be updated at all times. All orders will be subject to products being in stock.<\/p><h2>Guarantees<\/h2><p>To the extent that products are unavailable, but you have already placed your order, we will inform you of the unavailability of these products and recommend similar products of equal or similar value that can be ordered. To the extent that you do not wish to order the similar products recommended by us, we will cancel your order, and to the extent that you have already paid the price of the products, we will proceed to refund the money as soon as possible.<\/p><h2>Product pricing. Invoicing. Payment<\/h2><p>Product prices are displayed in lei on the website and include value added tax. The price of the products is as displayed on the website unless there is an error. To the extent that there is an error, we will notify you as soon as possible and will refund the amount of money overpaid or request an additional amount of money. To the extent that the new price is not satisfactory to you, you do not respond to our request or we are unable to contact you, we will cancel your order and refund the amount of money paid as soon as possible.<br \/>Transportation or delivery charges are included in the price unless otherwise stated on the website.<br \/>Product prices may be updated\/modified at any time and such update\/modification shall supersede any previous price. Your order will be subject to the prices at the time the order is actually placed.<br \/>Once you have chosen the product you wish to order and pressed the order button, the product will be automatically transferred to your shopping cart. Once you have placed all the products you wish to buy in the shopping cart, you will be able to place your order by scrolling through the order page. On the order page you will provide the information requested in Section 8.<br \/>Payment for ordered products is made by credit card online.<br \/>If you choose to pay online with your bank card, the processing of your card data is done through our processing partners and we will not store any data related to your card.<br \/>If you opt to pay by card, the issuing institution will proceed to validate and authorize the payment. If the transaction is not processed for reasons beyond our control (i.e. no funds on the card, expired card), the contract between us is not concluded and we will have no obligation to deliver the products, but you may select another payment method or try again to process the payment with a valid card.<\/p><h2>Delivery<\/h2><p>We deliver exclusively to customers who are individuals, legal entities, PFA, sole proprietorships or family businesses only to addresses in Romania and in the countries of the European Economic Area. At the time of delivery, it is obligatory for a person of legal age to sign for all products shipped. The order is considered delivered when you or another person takes physical possession of the Product, the signature of receipt of the order representing proof of delivery of the products.<br \/>No deliveries on Saturdays and Sundays. Please note that in certain situations, especially during the holiday season or Black Friday, delivery times may be extended, which may be due to the congestion of courier companies or other reasons beyond our control. The delay in delivery will not be due to our actions or inactions, but to an event external to us, in which case you agree not to hold us liable under any circumstances.<br \/>Delivery charges are listed on the order page.<br \/>Once the order has been entrusted to the courier company, the transportation risk is borne by the buyer.<\/p><h2>Product guarantee<\/h2><p>If the products purchased have manufacturing defects or damage in transit, please let us know, and if your claims are proven, we will refund the amounts paid and you will return the product.<\/p><h2>Force majeure and acts of God<\/h2><p>We will not be held liable for any delay or failure to perform our services due to force majeure or acts of God. You may not transfer, assign, charge or otherwise dispose of this Agreement or any of your rights or obligations under it without our prior written consent.
